Introduction

These Terms of Sale govern the sale and purchase of all goods, digital products, vouchers, prepaid credits, and services (“Items”) offered on the Platform.

Purchases are intended only for individuals who have reached the legal age of consent under applicable laws. If you are under the legal age, you must obtain permission from a parent or legal guardian, who agrees to be bound by these Terms on your behalf.

EXIMART reserves the right to amend, modify, or update these Terms of Sale at any time by posting the revised version on the Platform. Continued use of the Platform or continued purchases after such changes shall constitute acceptance of the updated Terms.

Definition

Account means a user account registered on the Platform.

Buyer means any person who purchases an Item on the Platform.

Contract means the binding agreement formed upon EXIMART’s issuance of an order confirmation.

Item means any product, digital good, voucher, prepaid credit, or service offered for sale.

Platform means EXIMART’s website, mobile application, and related systems.

Prepaid Balance means stored value credited to a Buyer’s Account for purchasing Items.

Formation of Contract

All Item listings on the Platform constitute an invitation to treat and do not constitute an offer.

A Contract is formed only when EXIMART issues an order confirmation to the Buyer.

EXIMART reserves the right to correct any errors, inaccuracies, or omissions relating to pricing, descriptions, or availability at any time, including after an order has been placed, without incurring liability.

Account Registration

A valid and active Account is required to place an order on the Platform.

The registration, use, suspension, and termination of an Account are governed by the Platform’s Terms of Use.

EXIMART reserves the right to verify identity or suspend Accounts for compliance, security, or fraud prevention purposes.

Orders, Cancellation & Refusal

All orders are subject to EXIMART’s acceptance at its sole discretion.

Once an order has been confirmed, it is final and non-cancellable, unless expressly approved in writing by EXIMART.

EXIMART reserves the right to refuse, suspend, or cancel any order at any stage, including after confirmation, without liability.

Where full payment has been made and cancellation is not due to the Buyer’s fault, EXIMART may issue a refund in accordance with these Terms.

EXIMART shall not be responsible for any failure, inability, delay, or error in the use, redemption, or activation of any voucher, code, or digital Item once it has been successfully delivered, unless such failure is directly caused by EXIMART.

Any inability to use a voucher or digital Item due to third-party platform restrictions, account limitations, regional restrictions, or user error shall not constitute liability on the part of EXIMART.

Upon successful completion of a purchase, a confirmation and/or delivery email shall be sent to the Buyer’s registered email address.

If the Buyer does not receive such email within thirty (30) minutes from the time of purchase, the Buyer must contact EXIMART promptly.

Failure to notify EXIMART within this timeframe shall be deemed conclusive acknowledgement that the Item has been successfully delivered and received.

Pricing

Prices displayed on the Platform are the prices applicable at the time of checkout and may include applicable taxes.

Prices may vary based on currency, jurisdiction, or payment method.

In the event of a pricing error, EXIMART reserves the right to cancel the affected order and refund any payment received.

Payment & Refunds

Full payment is required at checkout before an order is processed.

EXIMART accepts payment through the methods made available on the Platform.

Approved refunds may take up to thirty (30) days to process and will be made using the original payment method where possible.

Prepaid Balance

Prepaid Balance is not a bank account or trust account and carries no interest.

Prepaid Balance is non-transferable, non-withdrawable, and non-refundable.

Prepaid Balance may only be used to purchase Items on the Platform.

Prepaid Balance expires twenty-four (24) months from the date credited, unless otherwise stated.

Any unused balance will be forfeited upon expiry or account closure.

EXIMART reserves the right to impose balance limits and conduct verification in accordance with applicable laws.

Warranties

All Items are provided on an “as is” and “as available” basis.

EXIMART does not warrant that Items will be error-free, uninterrupted, or compatible with all platforms.

All implied warranties are excluded to the fullest extent permitted by law.

Limitation of Liability & Indemnity

EXIMART shall not be liable for indirect, incidental, special, or consequential losses, including loss of data, profits, or goodwill.

EXIMART’s total cumulative liability shall not exceed the amount paid by the Buyer for the Item.

The Buyer agrees to indemnify and hold harmless EXIMART from any claims, losses, or damages arising from the Buyer’s breach of these Terms.

Force Majeure

EXIMART shall not be liable for any failure or delay caused by events beyond reasonable control, including system failures, network outages, government actions, or natural disasters.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Malaysia, and all disputes shall be subject to the exclusive jurisdiction of the Malaysian courts.

Refund & Return Policy

All Items are non-refundable and non-exchangeable, except where expressly approved by EXIMART in writing.

• Codes are delivered electronically after successful payment
• Pre-orders are non-refundable

Direct Top-Up

• Buyers must ensure all account information is accurate at all times
• EXIMART is not responsible for losses arising from incorrect information
• Submitted account details cannot be amended after purchase
