Definition

Account: A registered user account created to access the Platform.

Buyer / User: Any individual or entity accessing or using the Platform.

Content: All information, text, images, software, data, and materials made available on the Platform.

Digital Items: Digital credits, cards, vouchers, or services offered on the Platform.

Intellectual Property: All trademarks, logos, copyrights, and proprietary materials belonging to EXIMART or third parties.

Legal Age: The minimum age required to legally enter into a binding agreement under applicable Malaysian law.

Platform: EXIMART and/or EXIPAY websites, mobile applications, and related services.

Services: The Platform, Digital Items, and any related features or content.

User ID: The unique identification assigned to your Account.

Licence to Use

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform solely in accordance with these Terms.

User Representations & Obligations

By using the Platform, you represent and warrant that:

  • You are of Legal Age, or have obtained consent from a parent or legal guardian.
  • All information provided during registration is accurate and up to date.
  • You are responsible for maintaining the confidentiality of your Account credentials.

You agree not to:

  • Use the Platform for unlawful, fraudulent, or misleading purposes.
  • Impersonate any person or misrepresent your identity.
  • Attempt to hack, reverse engineer, or interfere with Platform security.
  • Misuse rewards, points, credits, or promotional mechanisms.
  • Circumvent transaction limits, verification processes, or safeguards.
  • Use the Platform in violation of anti-money laundering, counter-terrorism financing, or sanctions laws.

Account Registration & Security

You may be required to create an Account to access certain features. We reserve the right to:

  • Verify your identity and request supporting documents.
  • Suspend or terminate Accounts with inaccurate or misleading information.
  • Conduct compliance checks where required by law.

You are responsible for all activities conducted through your Account until we are notified of unauthorized access.

Use of Services

You are responsible for obtaining the necessary devices and internet access.

Transactions performed through your Account are deemed authorized unless reported otherwise.

We may appoint third-party service providers to support the Platform.

Promotional communications may be sent to your registered contact details.

Digital Items & Rewards

Digital Items and reward points (e.g. EXIFT Points) have no cash value and are not redeemable for money.

Digital Items are licensed for personal use only and may not be resold or transferred unless expressly permitted.

Redemption and usage are subject to additional terms displayed on the Platform.

Availability & Verification

Certain features may be released in beta or limited access.

We may require identity verification for compliance, security, or dispute resolution.

We reserve the right to modify, suspend, or discontinue any part of the Platform without prior notice.

Disclaimers & Limitation of Liability

The Platform and Services are provided “as is” and “as available” without warranties of any kind.

To the fullest extent permitted by law, we shall not be liable for:

  • Loss of profits, data, revenue, or goodwill;
  • Service interruptions or technical issues;
  • Indirect, incidental, or consequential damages.

Intellectual Property

All Content and Intellectual Property on the Platform belong to EXIMART or respective owners. You may not copy, reproduce, modify, or distribute any materials without prior written consent.

Any feedback or submissions provided may be used by us without compensation.

Account Suspension & Termination

We may suspend or terminate your Account if:

  • There is suspected fraud, abuse, or illegal activity;
  • You breach these Terms;
  • Required verification is not provided.

Upon termination, unused balances or rewards may be forfeited where required by law or compliance obligations.

Disclosure of Information

We may disclose user information where required:

  • By law or regulatory authorities;
  • For fraud prevention or compliance purposes;
  • To enforce these Terms.

Personal data handling is governed by our Privacy Policy.

Governing Law

These Terms are governed by the laws of Malaysia, and disputes shall be subject to the jurisdiction of Malaysian courts.

Miscellaneous

Failure to enforce any provision does not constitute a waiver.

Invalid provisions shall be severed without affecting the remainder.

You may not assign your rights without our written consent.

Binding Effect

These Terms bind you and your successors, representatives, and permitted assigns.
